Ladies of New York , you are free to walk bare-breasted through the city! New York City's 34,000 police officers have been instructed that, should they encounter a woman in public who is shirtless but obeying the law, they should not arrest her. This is a good step towards gender parity in public spaces.

This decision means that breast exposure is not considered public lewdness, indecent exposure, or disorderly conduct. It also notes that, should a crowd form around a topless woman, the officer should instruct the crowd to disperse and then respond appropriately if it does not. Relative coverage is no longer a factor.

This policy shift comes after several years of litigation and protest. In the 1992 case People v. Ramona Santorelli and Mary Lou Schloss, the New York Court of Appeals ruled in favor of two women who were arrested with five others for exposing their breasts in a Rochester park, holding the law void as discriminatory.  The ruling was put to the test in 2005, when Jill Coccaro bared her breasts on Delancey Street in New York, citing the 1992 decision, and was detained for twelve hours. She subsequently successfully sued the city for $29,000.

In 2007, Go Topless, a national organization supporting gender equality in shirtlessness laws, established Go Topless Day. Dozens of women protest – often topless – in thirty cities around the United States, promoting equal rights to be shirtless. Protests usually include chants of “Free your breasts.  Free your minds” and a song “Let ‘em Breathe” to the tune of the Beatles’ “Let it Be.”

While some who have witnessed these events have suggested that "[t]his is extreme liberalism and why America’s in decline” or “[i]t’s degrading to women,” others have been supportive. One man even said he would encourage his wife to join them.

Though bare-breasted women might shock the sensibilities of some in the public, it is encouraging to see the police responding positively to gender bias, even on such a seemingly small scale. After all, no one thinks twice about a man shirtless on a summer day. However, the female nipple or chest is still considered “lewd.” By reminding its officers of this, the NYPD is publicly declaring that it will no longer perpetuate unconstitutional gender discrimination, a standard to which all law enforcement should be held and a decision for which it should be applauded.

Actually, it's legal for women to be topless on any of the public beaches in Dade County (and I believe Broward County as well). Not just South Beach.

Actually anywhere in Dade County, EXCEPT for the State Parks like Bill Bags.

Broward County varies by City.  Fort Lauderdale it is not legal unless under 8 years old, but often tolerated without incident.

the topless thong and body paint "desnudas" in Times Square are becoming more brazen in asking for money.  there are reports that the cops aren't approaching them because they are illegal aliens and aren't supposed to be bothered!!!http://nypost.com/2017/07/30/desnudas-have-gone-wild-in-times-square/
About Miami Beach I remember this being raised a couple of years ago- it was said that it's not "legal" but it's tolerated and no plans for enforcement.  In NY state it's been legal according to court cases--- more of an equal rights issue rather than a breast tanline issue!!Don't know- but the topfreedom movement probably won't sweep the nation as fast as legalized pot!  For one thing the states can't tax anything!  Well maybe someone will decide to tax nipple piercings $100 to raise money!

Well, thongs aren't even legal in state parks here, so it shouldn't be a surprise that toplessness isn't, either. lol

I think it's insane that women are not allowed to ("free the nipple) bare their breasts in public and women and men are not allowed to wear thongs in public. Both are as natural as one can get these days and authorities try to criminalize being in our natural

Years ago some ladies running a beach shop got some unanticipated publicity when one of their advertisements "went vital" so to speak, before the advent of the Internet.  In their exuberance they proclaimed "Our bikinis are the best in the World !  They're fabulous !  THEY'RE JUST THE TOPS !"

I could be wrong on this but I think society's social mores will eventually ease up so if women that would want to do this they can.  never made any sense to me why this law is here and I am really surprised these laws haven't been found to nconstitutional

A swimwear shop I was in a year or so ago (in France) had a woman's swimsuit line with only one cup.  There were both bikini and one-piece suits available.  The owner told me these were worn at topfree beaches by women who had a mastectomy.  They could expose the good breast, and hide the rebuilt or missing breast, which rarely looks natural.  However, she said women who had never needed breast work were also buying these suits -- usually in pairs with one covering the left breast only, and the other covering the right breast only.  She told me that women were wearing these single breast exposing swimsuits to "normal" beaches, and if the officials came, or they were ticketed or arrested, they often were able to get off with a defense of "the law says exposure of the "breasts" is not permitted.  I am not showing my "breasts" but only one, and therefor am not violating the law.  Some rules and laws were supposedly changed to make exposure of a single breast also a crime.

Maybe someone in the US should check into this.  Perhaps some custom women's swimwear place could supply suits for this purpose.  I might try something like this myself at some places where topfree rule enforcement is not heavy-handed.  Besides, the look is sort of cool.
