Years ago my neighbor built a fence to block her view of my nude body in my back yard. Her fence blocked my view of the golf course, so I sued her. She defended her action by claiming I was nude in public, which apparently is illegal in my county. Fortunately, the golf course is privately owned, which meant that my back yard is surrounded by private property, so I was not visible from public property.

I pass this information along in case someone tries to stop your nude sun bathing in your back yard; all you have to do is pay a lawyer a few grand to assert your rights, assuming that, where you live back yard nudity is not illegal if it's not visible from the street or any other public property.
I trust that your rights to wear a thong in your back yard would be similarly protected...but then, I'm not a lawyer.

me either, but it sounds like she tried to mix  criminal laws with a civil action. ( always a big no-no)  bottom line ( no pun intended!), she can build whatever fence she wants as long as it's within regulations of your city and subdivsion, and you have the right to sue her for whatever!  i prefer the free market approach, if you don't like it, then sell and she can do the same....otherwise we're just making the lawyers rich.

Curious - What state do you live in and what became of your suit? Also, where I live all the roads in our development are private. Would I be legal even if visable from the road?

Thanks,

Roger, I can't tell you about the laws in your state.  I live in Oregon.  My female neighbor was on good speaking terms with my wife and mem but even so, she did not speak to us about my exhibitionism, but instead hired a handyman to construct the fence.  As the fence went up I tried to confront her about the violation, but she would run inside when she saw me coming (I was dressed!), so I knew a lawsuit would easily prove she was in violation.  As this lawsuit took shape, my wife sued for divorce (that was an entireloy different matter) and so my neighbor siezed on that and agreed to tear down the fend if I agreed to move out of the neighborhood!  Since I was moving anyway, I agreed to that, but I wouldn't hesitate to move back to that same house some day if the opportunity arose, and sue her again if she built the fence in violation of the code.  The only bad feeling I had about all that was that the llawyers dragged the whole suit on and on until finally I told them to get done with it.  They were both milking us for all the money they could get, dammit!

I lived for years in Cedar Hills, an old and well-established, middle-income development of 2,100 homes that had mandatory membership in their homes association.  That's the way to fly, because whenever someone violated the rules, the association's office sued them and the attorney always won in court and the complaining homeowner never had to pay a cent for any of that.  Then I moved up, so to speak, to a classier neighborhood on a golf course (Rock Creek), and their optional homes ownership requirement resulted in almost no one paying dues to belong, so they had no lawyers and no interest in enforcing the written rules.  That cost me thousands to get that lady to take down her illegal fence.  What a lesson!

The lessons were:

1. Check the history of CC&R enforcement by your homes association.  Poor enforcement will probably result in home values dropping over time as people get away with violations.  People live like pigs when allowed.

2. Even though you're definitely in the right to insist on your neighbors observing the written code in your neighborhood, it can be very costly to defend that right.

So public nudity is only illegal in some counties in Oregon? Also, if you were only visible to a private golf course and your neighbor in her yard - were you really publically naked? Assumming you were illegally naked - you are fortunate that no one pressed charges - IMHO.

Thanks,
Roger

I may be alone in thinking this, but if a choice of clothing comes down to working out legal definitions and such, it's just not worth the trouble.

I mean, jeez, it's just clothes. There are more important things to take to court.

it's time to move.....if you're having to fight that hard to do what you're wanting to do, it's just not worth the trouble. move to florida! even if you win, you're still going to have problems...flat tires on your car, etc.

I guess that Brad Pitt thinks it's legal as he's been caught sunbathing nude by a photographer on an apartment balcony recently- in S. California I guess.  He's threatened to sue anyone who releases the photos, like his ex, Jennifer Anniston did recently over some photos taken of her sunbathing topless in her backyard.  A few months ago there were some photos of Janet "overexposure" Jackson taken of her sunbathing nude at her house too, that they threatened to sue over.

Who knows if any of these exist, it may just be press releases to get exposure in the press......."lose the tanlines, get in the headlines"

In addition to the obvious PR vehicle these incidents provide to the celebrities---it also says  "I've been doing this, in private mind you, but it's perfectly normal"

Now notice that these people weren't doing it in semipublic....like in a visible backyard or deck.

Roger, I don't understand where you got the idea that public nudity was allowed in one Oregon county and not in another.  However, I know that neighboring Multnomah County (where Portland is) has been declared by a judge to be "public-nudity-legal", but I have no idea if that applies to other counties.

That explains some of what I read and see about Oregon. For example, the Summer Soltice Parade where naked bicyclist are allowed, the story of the man reported for swimming naked by the bridget and resaurant, but not cited for IE, the naked World Naked Bike riders. Makes me wish I was in that county in Oregon. ;-) Assuming such conditions do not lead to utter chaos and mahem in that county, perhaps it will be an arguement for adjusting the IE laws in the rest of the United States.

There's been talk about sunbathing nude at beaches where this is illegal. Some people seem to be talking about different situations with some misunderstandings. I've been in situations where suits come off in different ways and the public situation varies a great deal. We maybe ought to try to standardize what we're talking about. Of course the true Clothing Optional is freely walking , swimming and sunning nude without a care. ?"nude" I've been at beaches where slipping out of the suit in the water was possible, and putting it back on when exiting the water was expected. ?"skinny dipping" I've been on beaches where slipping off the suit to "sunbathe" , lay down, behind a windscreen or in a towel covered chair , and placing a towel in the crotch when someone walks in front was commonplace. That said others walking down the beach wouldn't see or be offended. Of course walking around/swimming meant wearing a suit. ??"discreet nude sunbathing" This can mean even that the viewing of the nudity only occurs when walking up to the enclosure or behind the screen. This may mean that the authorities will not object or must go out of their way to enforce clothing rules.

It is also legal to be nude in England (anywhere), trouble is the police don't always know that and there are other vague laws that can catch you out. Police guidance here and worth a read if you are in England: https://library.college.police.uk/docs/nudity.pdf Extract relevant to being outdoors in public - i.e. what police should tell anyone who calls them: Passive behaviours in public: Sunbathing, walking, cycling, swimming, gardening, home maintenance, etc. Provide advice If they are just being naked in public, it will be lawful activity Explain to caller that no offences are being committed No police action necessary

Sunbathing topless is legal in Canada, but I don't think nude sunbathing is legal.

MY backyard can be entered only by opening a latched gate and passing a sign warning of nudity.  For all that, four times over the years people distributing religious literature have come in to find me nude, or one time wearing one of those "loincloths" that have only a dozen strands of fringe hanging down in front.  The non-covering fringe brought on the biggest gasp of them all.
